RESOLUTION AUTHORIZING A RELEASE OF EASEMENT

WHEREAS, G & K Joint Venture has requested the release of a five-foot public utility and drainage easement across the following described property:
The North 140.00 (as measured along the East line thereof) of the East 5.00 feet (measured perpendicular to the East line thereof) of Lot 1 in Regency Grove Condominiums Plat of Consolidation recorded 8/15/96 as Document No. R96-134915 in Sections 5, 6,7, 8, and 18, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, IL.; and,
WHEREAS, Village staff has reviewed the request and recommends the Release of said easement; and,
WHEREAS, the President and Board of Trustees have voted to concur with said recommendations; and
WHEREAS, the property owner has secured Letters of Release from the utility companies, to the extent necessary, as to said easement;
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lombard, DuPage County, Illinois, that the President and Village Clerk be and they hereby are authorized to execute a Release of the easement hereinbefore described, said Release to be in substantial conformance with the Release attached hereto as Exhibit "A" and made a part hereof.

RELEASE OF EASEMENT
THIS INSTRUMENT made this ___________day of ___________________, 1998 by the VILLAGE OF LOMBARD, a municipal corporation, DuPage County, Illinois.
WHEREAS, the owners have requested the Village of Lombard and the utility companies involved to release the public easement across their property as more fully described below; and
WHEREAS, the Village of Lombard and the utility companies involved have consented to the release of said easement; and
WHEREAS, the release of said easement is not detrimental to the best interests of the Village of Lombard;
NOW, THEREFORE, IN CONSIDERATION of the foregoing premises and other good and valuable considerations, the receipt and sufficiency of which are hereby acknowledged, the Village of Lombard, a municipal corporation, DuPage County, Illinois, hereby releases and abandons a five-foot public utility and drainage easement across the following described property:
The North 140.00 (as measured along the East line thereof) of the East 5.00 feet (measured perpendicular to the East line thereof) of Lot 1 in Regency Grove Condominiums Plat of Consolidation recorded 8/15/96 as Document No. R96-134915 in Sections 5, 6,7, 8, and 18, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, IL.
Commonly known as the southwest corner of Grove and Charlotte Streets.
