AN ORDINANCE GRANTING A CONDITIONAL USE PURSUANT

TO TITLE 15, CHAPTER 155, SECTION 155.208 OF THE LOMBARD

ZONING ORDINANCE AND VARIATIONS TO THE LOMBARD

ZONING ORDINANCE, TITLE 15, CHAPTER 155, AND THE

LOMBARD SIGN ORDINANCE, TITLE 15, CHAPTER 155.

                                          WHEREAS, the President and Board of Trustees of the Village of Lombard have heretofore adopted the Lombard Zoning Ordinance, otherwise known as Title 15, Chapter 155 of the Code of Lombard, Illinois; and,

 

                                          WHEREAS, the subject property is zoned I Limited Industrial District; and,

 

                                          WHEREAS, an application has been filed requesting conditional use approval to provide for more than one building on a zoning lot on the property described in Section 2 below; and,

 

                                          WHEREAS, a public hearing on such application has been conducted by the Village of Lombard Plan Commission on December 10, 1997 pursuant to appropriate and legal notice; and,

 

                                          WHEREAS, the Plan Commission has filed its recommendations with the President and Board of Trustees recommending approval of the conditional use described herein; and,

 

                                          WHEREAS, the President and Board of Trustees approve and adopt the findings and recommendations of the Plan Commission and incorporate such findings and recommendations herein by reference as if they were fully set forth herein;

 

                                          NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LOMBARD, DU PAGE COUNTY, ILLINOIS, as follows:

 

                                          SECTION 1:  That a Conditional Use is hereby granted for the property described in Section 2 below and pursuant to Title 15, Chapter 155, Section 155.208 of

the Village of Lombard Zoning Ordinance so as to allow more than one building on a zoning lot;

 

                                          SECTION 2:  That this ordinance is limited and restricted to the property generally located at 1100-1130 N. Garfield Road, Lombard, Illinois and legally described as follows:

 

Lot 5 in Lombard Business Park Plat of Consolidation of Lots 5 and 6 in Lombard Business Park of part of Section 32, Township 40 North, Range 11, East of the Third Principal Meridian, according to the Plat of Consolidation recorded September 8, 1989 as Document No. R89-112217 in DuPage County, IL.

                                          SECTION 3:  This ordinance shall be approved  subject to compliance with the following conditions:

 

1.  That the site be developed in substantial compliance with the site plan as prepared by Victor Pojman, A.I.A., Architect, originally dated September 1\29, 1997, and last revised on October 21, 1997.

 

2.                     That landscaping be provided in substantial compliance with the landscaping plan as prepared by the R. Glass Landscape Company, originally dated October 29, 1997 and last revised November 26, 1997.

 

3.                     That a variation be granted from Sections 155.706 and 155.708 to waive foundation and parking lot landscaping between the two buildings.

 

4.                     That a variation be granted from Section 153.507.B.4 to permit two freestanding signs on one lot-of-record.

 

5.                     That construction shall be substantially underway within one (1) year from the date of Village Board approval and shall be completed within three (3) years thereof.

 

                                          SECTION 4:  This ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
