AN ORDINANCE GRANTING A VARIATION OF THE

LOMBARD FLOOD CONTROL ORDINANCE

CHAPTER 151 "FLOOD CONTROL" OF THE LOMBARD CODE OF

ORDINANCES, SUBSECTION 151.55 "RETENTION/DETENTION BASINS"

                                          WHEREAS, the President and Board of Trustees of the Village of Lombard have heretofore adopted the Code of Lombard, Illinois, and;

 

                                          WHEREAS, an application has been filed with the Village of Lombard requesting a variation from Chapter 151 "Flood Control" of the Lombard Code of Ordinances, Subsection 151.55 "Retention/Detention Basins".

 

                                          WHEREAS, a public hearing has been conducted by the Board of Trustees on January 22, 1998 pursuant to appropriate and legal notice; and,

 

                                          WHEREAS, the President and Board of Trustees approve and adopt the findings and recommendations of staff and incorporate such findings and recommendations herein by reference as if they were fully set forth herein;

 

                                          NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LOMBARD, DU PAGE COUNTY, ILLINOIS, as follows:

 

                                          Section 1:  That a variation is hereby granted from the provisions of Chapter 151 of the Code of Lombard, Illinois, for the property described in Section 2 below and to allow the construction of a new dental office building with an on-site parking lot without the required post development stormwater detention storage volume and release rate.

 

                                          Section 2:  That this ordinance is limited and restricted to the property generally located at 116-120 E. St. Charles Road, Lombard, IL and legally described as follows:

 

LOT 5 IN BLOCK 18 IN H.O. STONE & COMPANY'S ADDITION TO LOMBARD, BEING A SUBDIVISION OF PART OF THE SOUTHWEST QUARTER OF SECTION 5 AND OF PART OF THE NORTHWEST QUARTER OF SECTION 8, TOWNSHIP 39 NORTH, RANGE 11 EAST, OF THE THIRD PRINCIPAL MERIDIAN, IN DUPAGE COUNTY, ILLINOIS.

 

AND

 

LOT 6 IN BLOCK 18 IN H.O. STONE & COMPANY'S ADDITION TO LOMBARD, BEING A SUBDIVISION OF PART OF THE SOUTHWEST QUARTER OF SECTION 5 AND OF PART OF THE NORTHWEST QUARTER OF SECTION 8, TOWNSHIP 39 NORTH, RANGE 11 EAST, OF THE THIRD PRINCIPAL MERIDIAN, IN DUPAGE COUNTY, ILLINOIS.

                     Section 3:  That this ordinance shall be subject to the following conditions:

 

A.                     That a 2" minimum restrictor be installed in the detention facility.

 

B.                     That 0.044 acre-feet of detention storage be provided given the 2" restrictor size.

 

C.                     That payment in the amount of $915.00 (0.061 acre-feet at $15,000.00 per acre-foot or $915.00), which is the amount for the balance of detention not constructed at a rate of $15,000.00 per acre-foot, be collected from the petitioner prior to issuance of building permits and deposited in the Village of Lombard Water and Sewer Capital Reserve Fund.

 

D.                     That the normal fee of $150.00 to process the variation (151.56, D) be deposited in the Village of Lombard Water and Sewer Operating Fund.

 

E.                     That the cost of the variance in the amount of $2,000.00 (20 P.E. at $100.00 per P.E. or $2,000.00), which is the minimum amount allowable by Ordinance (151.56, I), be collected from the petitioner upon approval of this variance.

 

                                          Section 4:  This ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
